On March 5, 2026, 18 children and youth from across California will stand before the Ninth Circuit Court of Appeals in Genesis v. EPA, challenging a federal agency whose policies treat children’s lives as worthless.
The youth plaintiffs argue that the EPA, the very agency charged with protecting children’s health and welfare, has systematically discounted the economic value of their lives and their future when determining how much climate pollution to allow. By doing so, the government is violating their constitutional rights to equal protection of the law, including their fundamental right to life.
The young plaintiffs are already living with the decades-long consequences of these economic and pollution policies, including extreme heat, wildfire smoke, asthma attacks, evacuations, displacement, and exposure to dangerous air pollution. These harms threaten their health and their lives. They’re asking the Ninth Circuit to reinstate their case and rule that courts have a duty to hear constitutional claims brought by children whose lives and rights are harmed by government policies.

Come see democracy in action and support the youth. We’ll gather outside the courthouse to rally and cheer on the youth plaintiffs as they enter the courthouse, and then pack the main courtroom and an overflow room. After court proceedings, we’ll reconvene outside where you’ll hear from the youth and their attorneys.

IMPORTANT NOTES
Courtroom capacity is limited, and seating is first-come, first-served. An overflow room in the courthouse will be available, where oral arguments will also be livestreamed.
Please arrive early if you plan to attend in person. All attendees must bring a valid ID. Teachers and chaperones bringing students should ensure students bring identification if they have one. Please be respectful of our federal court and court staff, and be ready to pass through security. Limit personal belongings to make screening easier. Photography and audio, or video recording, are prohibited inside the courthouse.
